Terms and conditions
SCOPE
The following General Terms and Conditions ("GTC") apply exclusively to the business relationship between kitchandtool.com and the customer in the version valid at the time the order is placed. Kitchandtool.com does not recognize any deviating terms and conditions of the customer and hereby expressly objects to them unless kitchandtool.com has expressly agreed to their validity in writing. The general terms and conditions of sale set out below constitute a legal contract between the online shop customer and kitchandtool.com.
ORDER
Kitchandtool.com online shop contains product information, technical information and links for informational purposes only. It may also be that the colors of the products differ from the actual products, due to color adjustments made. In these cases, Kitch & Tool Co., can in no case be held responsible.
1.1 The products / services sold are described on the website kitchandtool.com at time of purchase.
1.2 The products are available on the website depending on the stock availability.
When you validate your order by clicking on the "Validate payment" button, we will send you a confirmation of purchase by e-mail. The contract is then concluded with the receipt of this e-mail. The order is then considered as a firm and final purchase and you implicitly declare that you have read and accepted the conditions of sale. The reproduction of the products in the online shop is not a binding order by law, but represents only an online catalogue without commitments. If you only place products in the "shopping cart", it is not yet a binding order. It becomes binding only after clicking on the "Validate payment" button at the end of the payment process.
Kitchandtool.com reserves the right to accept or refuse any orders without notice.
Any order cancellation is subject to an administrative fee. This fee amounts to a total of CHF 20. - (participation in administrative costs and logistical handling). When fulfilling shipping address information, you automatically accept that the shipping address may be given to a third party handling the shipping and only for this purpose.
We accept orders from our website kitchandtool.com also by e-mail: sales@kitchandtool.com. These will be processed as quickly as possible within the limits of our available stock or subject to stocks available from suppliers.
However, if the products are temporarily unavailable (out of stock, reissue, etc.) after your order, you will be informed by e-mail and invited to modify your order if you wish. If the products prove to be permanently unavailable (exhaustion of stock, end of production, etc.) after order. We will automatically cancel your order and inform you by email.
Retention of title and transfer of risks
The transfer of ownership of the products for the benefit of the purchaser, will be realized only after complete payment of the price by the latter, and this regardless of the date of delivery of the said products.
PRICES
Important: For deliveries in Switzerland, prices include tax and shipping costs but doesn’t include possible customs charges above a certain amount.
The prices of our products are indicated in CHF (Swiss francs) (Tax included for Switzerland) and all orders are payable in CHF (Swiss francs). The shipping costs are included and therefore not added in the final statement before the validation of the payment.
Kitchandtool.com reserves the right to change its prices at any time and without any notice. Orders placed before the price change will not be affected. The prices listed on the order confirmation are binding.
IMPORTANT: CUSTOMS CHARGES,
please also take into account any customs charges above a certain order amount which are not included in the price (see "Customs Charges").
The price of the goods at the time the order is received by kitchandtool.com, is decisive.
Kitchandtool.com reserves the right to price errors and changes.
TERMS OF PAYMENT
You can use the following payment methods to purchase our products:
CREDIT CARDS:
Payment is made by debiting your credit card. We accept VISA and MasterCard. You enter your credit card data during the ordering process via a secure connection in our online shop and we transmit your data in encrypted form directly to our payment provider. For security reasons, we do not store your credit card details and details will not be shared with third parties. Your credit card will only be charged once the order process has been completed. We will ship your order immediately.
PAYPAL
With Paypal, forget your credit card numbers and your secret codes, your email address and a password are enough. By using PayPal it is simple and secure, your financial information is never communicated to the merchant site.
DELIVERIES

Deliveries are generally only possible within Switzerland. Information about the delivery date is not binding. Exceeding the delivery period does not entitle you to compensation. If kitchandtool.com is unable to deliver the ordered goods through no fault of its own because one of kitchandtool.com’s suppliers does not fulfill its contractual obligations, kitchandtool.com is entitled to withdraw from the ordering party. In this case, the customer will be informed immediately that the ordered goods are not available. If delivery to the customer is not possible because the customer cannot be found at the delivery address specified by him, an administrative fee of CHF 20. - will be charged for all packages not claimed or refused by the recipient.
All our packages are checked on departure: it is up to the recipient to check them on receipt, including checking the good condition of the strapping and adhesive tape. Our goods travel at the risk of the consignee. In case of delay taken by the carrier, loss or theft in your mailbox, our liability can not be engaged for any reason whatsoever. Consequently, no claim for compensation of any kind may be claimed from the merchant.
Any transport damage found must be reported to the delivery service immediately upon receipt of the goods. In this case, please refuse acceptance and have the parcel returned by the parcel service. You must also report any shipping damage to KitchandTool.com within 7 days of receipt of the goods. We will refund any damaged items free of charge and promptly reship the ordered goods.
Customs fees
For any delivery in Switzerland, please note additional customs fees for any order above a certain amount and are not included in the purchase price. The customs costs for any delivery, customs fees and formalities are, unless otherwise indicated, the exclusive responsibility of the customer who undertakes to check the possibilities of importation of the products in the country of delivery. These costs can amount to 11.50 CHF + 3% of the total value of the goods.
If shipments whose total value (including transport, customs clearance, insurance and customs duties) does not exceed the following amounts shall be imported without paying taxes:
- for a maximum total value of CHF 65 (for a VAT rate of 7.7%)
Delivery time
The delivery time includes the time of preparation of the package and the time of transport. Kitchandtool.com will not be liable in case of delay of delivery. However, if the products are temporarily unavailable (out of stock, reissue, etc.) after your order, you will be informed by e-mail and invited to modify your order if you wish. If the products prove to be permanently unavailable (exhaustion of stock, end of production, etc.) after order, we will automatically cancel your order and inform you by email.
In rare cases, however, multiple orders may be placed on the same item at the same time, which could affect product availability.
Delay or incomplete delivery
We remind you that in case of delay of postal services, theft or loss of your parcel, kitchandtool.com cannot be held responsible and declines any responsibility. No compensation can be claimed.
Unclaimed parcels and those whose address has not been correctly provided to us will be invoiced to the customer for an amount of CHF 20. -
Right of Withdrawal
Any purchase being firm and definitive, no item will be taken back or exchanged unless error of order preparation or reception of defective product and manufacturing defect.
Please inform us immediately, within 24 hours of receipt of your order by e-mail to sales@kitchandtool.com, after this time no compensation can be claimed.
RESPONSIBILITY
The products offered on the kitchandtool.com website comply with the applicable Swiss legislation.
Under no circumstances can we be held responsible for the misuse of the products sold on our kitchandtool.com website, in particular the use for a use other than that intended by the manufacturer of the product, the non-compliance with storage instructions, physical or bodily damage that could result from a product malfunction or allergy.
The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, we cannot be held liable in case of error or omission in one of the photographs, texts, graphics or product characteristics or in case of changes in the characteristics of the products made by the suppliers.
We disclaim any responsibility for the content of the sites on which hypertext links may return from our own site.
ACCEPTANCE OF THE BUYER
DATA SECURITY
Our online shop is encrypted using SSL, which means that all of your offer data, your payments and your customer data are securely transmitted to us. We store your order data and treat them as strictly confidential. The relevant data is processed and used for the establishment, implementation and processing of the contracts concluded via the online shop and for the purpose of future customer support and customer care. Credit card data are not stored by us.
JURISDICTION AND APPLICABLE LAW
In the case of legal disputes, Swiss law applies exclusively.
The place of jurisdiction is determined by the Place of Jurisdiction Act and, in the case of orders by consumers, is at the consumer's place of residence.
FINAL PROVISIONS
Should individual provisions of the contract with the customer, including these GTC, be wholly or partially invalid, or should the agreements contain a loophole, this shall not affect the validity of the remaining provisions. The wholly or partially ineffective provision will be replaced by an effective provision whose economic success comes closest to that of the ineffective provision.
Kitchandtool.com expressly reserves the right to adapt the GTS to the circumstances at any time and to apply them immediately.
